Les falles de Torrent protegiran els seus fitxers amb dades per a complir la normativa de la Llei Orgànica 15/1999 de Protecció de Dades de Caràcter Personal (LOPD). Les comissions falleres de la capital de l’Horta Sud han rebut una xarrada de mà de la Junta Local Fallera i de l’empresa Idees Consultors en el saló d’actes de l’Ajuntament de Torrent per a posar-se les piles i rebre assessorament en la matèria. El delegat de Cultura, Modest Muñoz, va donar la benvinguda als presents i va agrair a l’expert José Miguel Aparicio la seua atenció. Des de la consultora s’ha destacat la importància que des del propi Ajuntament i la Junta Local es forme els fallers en esta matèria.
Així les 29 comissions de Torrent van assistir a la reunió, ja que una Falla -constituïda com a Associació Cultural-, es maneja dades personals de membres i proveïdors, com ara comptes bancaris, direccions, correus i la resta de que cauen sota l’àmbit de la LOPD. L’expert va respondre als dubtes dels fallers presents. Una de les resoltes quant a la responsabilitat, va ser la d’aclarir que el responsable del fitxer de dades és el mateix responsable d’una falla: el president.
D’altra banda va destacar que les dades dels censos, bases de dades de membres vigents, etc. comporta unes pautes específiques que marca la Llei, així com el bloqueig de les dades dels fallers que causen baixa, i que de forma sistemàtica es vulneren per falta de coneixement. Uns altres dels dubtes van ser les possibles sancions, ja que l’incompliment de comunicació o inscripció de fitxers en l’Agència de Protecció de Dades ve tipificat com a falta lleu, la qual cosa es traduïx en una multa que oscil·laria entre els 900 fins als 40.000 euros.
D’esta manera l’Ajuntament tendix una mà a les falles a través de la Junta Local i inicia el procés per a posar en orde tots els fitxers de dades de les comissions i així evitar possibles conseqüències.
Adaptats a la normativa
L’entrada en vigor de la LOPD donava un termini per a la seua adequació de dotze anys a comptar del 24 d’octubre de 1995, termini que va complir el 24 d’octubre del 2007. De manera que els fitxers no automatitzats preexistents a esta data han d’estar davall el coneixement de l’Agència Espanyola de Protecció de Dades (AEPD).
Tal com resa la llei pretén “garantir i protegir, en la qual cosa concernix al tractament de les dades personals, les llibertats públiques i els drets fonamentals de les persones físiques, i especialment del seu honor i intimitat personal i familiar”. D’això també es desprén l’ús de la imatge. De manera que els fallers hauran de firmar el seu consentiment (qui ho desitge) que s’usen fotografies en l’àmbit faller.
